The UK welfare system provides financial support for people who are unemployed, disabled, on a low income, or unable to work. You have legal rights to claim benefits if you meet the eligibility criteria, and to challenge decisions you disagree with. The main working-age benefits are Universal Credit (UC) and Personal Independence Payment (PIP).

Right to Claim Benefits

If you meet the eligibility criteria, you have the legal right to claim benefits. The DWP cannot refuse a valid claim. Universal Credit is the main means-tested benefit for working-age people and replaces six legacy benefits (JSA, ESA, Income Support, Housing Benefit, Tax Credits, and Working Tax Credit).

Right to a Correct Assessment

If you claim PIP or the health-related element of UC, you have the right to a fair assessment. The assessment must be carried out by a qualified health professional, and you can provide additional evidence from your GP, specialist, or support worker.

Right to Challenge Decisions

You can request a mandatory reconsideration within one month of any benefits decision, followed by an appeal to the First-tier Tribunal (Social Security). Tribunal appeals are free and have a high success rate (around 70% for PIP).

Right to Hardship Payments

If your Universal Credit is reduced because of a sanction, you can apply for hardship payments if you cannot meet your essential living costs. These are recoverable (they are deducted from future payments) but provide a safety net.

Right to Backdating

Universal Credit can be backdated for up to one month if you can show good reason for not claiming earlier (e.g., illness, disability, domestic abuse). Some legacy benefits have longer backdating periods.

Common Myths

Myth

If I'm sanctioned, I lose all my benefits

Reality

Sanctions reduce your standard allowance but do not affect housing costs, childcare, or disability elements of UC. You can apply for hardship payments.

Myth

I can't claim benefits if I'm working

Reality

Universal Credit is designed for people in and out of work. Your UC payment is gradually reduced as your earnings increase (taper rate of 55p for every £1 earned above the work allowance).
